1. Introduction

These Terms of Service ("Terms") govern your use of the Kassa AI chatbot platform, website, and related services (collectively, the "Services") provided by SamDad Consulting Limited (trading as "Kassa", "we", "our", or "us").

By registering for, accessing, or using our Services, you agree to be bound by these Terms. If you are entering into these Terms on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these Terms. If you do not agree to these Terms, please do not use our Services.

2. Description of Services

Kassa provides an AI-powered chatbot that you can embed on your website. The chatbot is trained on the content you provide (your website, FAQs, and other business information) to answer visitor questions, capture leads, and route support tickets to your dashboard.

Key features include:

  • Lead capture with instant email alerts
  • Business hours & away mode
  • Support ticket inbox
  • Custom branding and appearance control
  • Usage analytics (on Pro plans)

We may update, modify, or enhance the Services from time to time at our discretion, provided that such changes do not materially reduce the core functionality you have subscribed to.


3. Account Registration & Responsibilities

3.1 Account creation

To use our Services, you must create an account by providing accurate, complete, and up-to-date information. You are responsible for maintaining the security of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorised use of your account.

3.2 Eligibility

You must be at least 18 years old to create an account and use our Services. By using our Services, you represent and warrant that you meet this eligibility requirement.

3.3 Your business content

You are solely responsible for the content you provide to train the chatbot (e.g., website text, FAQs, business policies). You represent and warrant that you have all necessary rights to provide this content and that it does not infringe any third-party rights or violate any applicable laws.


4. Subscription, Fees & Billing

4.1 Free trial

New users may start with a 7-day free trial with full access to all features of the plan you select. No payment method is required to start the trial. At the end of the trial, you will be prompted to choose a paid plan to continue using the Service. We will not charge you automatically unless you actively subscribe.

4.2 Paid plans

We offer the following subscription plans:

  • Starter: £9.99/month (or £99/year) — includes up to 300 messages/month.
  • Growth: £24.99/month (or £249/year) — includes lead capture, instant alerts, and up to 1,500 messages/month.
  • Pro: £49.99/month (or £499/year) — includes unlimited messages, analytics dashboard, and priority support.

All prices are in British Pounds (£) and exclude applicable taxes (e.g., VAT).

4.3 Billing and renewals

Subscriptions are billed monthly or annually (depending on your selection) in advance. Your subscription will automatically renew at the end of each billing cycle unless you cancel it before the renewal date. You can cancel or change your plan at any time from your dashboard. If you cancel, you will not receive a refund for the current billing period, but you will continue to have access to the Services until the end of that period.

4.4 Payment processing

We use Stripe as our third-party payment processor. Your payment details are collected and processed by Stripe in accordance with their privacy and security policies. We do not store your full payment card information on our servers.


5. Acceptable Use Policy

You agree to use our Services only for lawful purposes and in a way that does not infringe the rights of, restrict, or inhibit anyone else's use and enjoyment of the Services. Prohibited activities include:

  • Using the Services for any illegal, fraudulent, or deceptive purpose.
  • Uploading or providing content that is defamatory, obscene, abusive, or hateful.
  • Attempting to reverse engineer, decompile, or extract the source code of our software.
  • Using the Services to distribute malware, viruses, or other harmful code.
  • Misrepresenting the AI as a human agent — Kassa is designed to always disclose that it is an AI, and you agree not to attempt to hide or obscure that disclosure.
  • Interfering with or disrupting the integrity or performance of our Services.

We reserve the right to suspend or terminate your account if we reasonably believe you have violated this Acceptable Use Policy.


6. Intellectual Property

6.1 Our intellectual property

The Kassa platform, including its code, algorithms, design, branding, and trademarks (including the "Kassa" name and logo), is owned by us and protected by copyright, trademark, and other intellectual property laws. We grant you a non‑exclusive, non‑transferable, revocable licence to use the Services solely for your internal business purposes, in accordance with these Terms.

6.2 Your content

You retain all ownership rights to the content you upload, link, or provide to the Services (your website text, FAQs, business information, etc.). By providing this content, you grant us a limited licence to use it solely to operate, train, and improve your chatbot and provide the Services to you. We will not use your content to train a public model or for any purpose unrelated to your own account without your explicit consent.


7. Data Privacy

We take your privacy seriously. Our collection, use, and storage of your personal data is governed by our Privacy Policy. By using our Services, you consent to our processing of your data in accordance with that policy. For your business data (conversations, leads, customer inquiries), you are the data controller and we act as your data processor.


8. Disclaimer of Warranties

Our Services are provided "as is" and "as available", without any warranties of any kind, either express or implied. We do not warrant that:

  • The Services will be uninterrupted, secure, or error‑free.
  • The chatbot will always provide accurate, complete, or up‑to‑date answers (the quality of responses depends on the quality of the content you provide).
  • Any results obtained from the use of the Services will meet your expectations.

You acknowledge that Kassa is an AI tool and may occasionally produce incorrect or unexpected outputs. We recommend reviewing the chatbot's responses periodically to ensure they remain accurate.


9. Limitation of Liability

To the maximum extent permitted by law, Kassa and SamDad Consulting Limited shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or business opportunity, arising out of or related to your use of the Services.

Our total liability to you for any claims arising under these Terms shall be limited to the amount you have paid us for the Services in the 12 months preceding the claim. This limitation applies regardless of the legal theory (contract, tort, or otherwise).

⚖️ Nothing in these Terms excludes or limits our liability for: (a) death or personal injury caused by our negligence, (b) fraud or fraudulent misrepresentation, or (c) any matter that cannot be excluded or limited under applicable law.


10. Termination

10.1 Termination by you

You may cancel your account at any time from your dashboard. Cancellation will take effect at the end of your current billing period. You will not receive a refund for the remaining period, but you will continue to have access to the Services until the end of that period.

10.2 Termination by us

We may suspend or terminate your account immediately if:

  • You breach these Terms (including the Acceptable Use Policy).
  • We are required to do so by law.
  • Your account is inactive for an extended period (over 12 months) and you have no active subscription.

Upon termination, we will delete or anonymise your personal data within 30 days, except where we are required to retain it for legal or regulatory purposes.


11. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.


12. Changes to These Terms

We may update these Terms from time to time to reflect changes in our Services, legal requirements, or business practices. We will notify you of any material changes by posting the updated Terms on this page and updating the "Last updated" date at the top. If you do not agree to the updated Terms, you may cancel your account before the changes take effect.
